Why?

Why can't I sack someone who doesn't work to the standards. HR is driving me insane. I know there has to be a fair process but arghh

She should never of been allowed past the trial period but the outgoing person really didn't give a damn by then and now I am stuck with someone who is not capable. I have people who refuse to deal with her and will hang up if she answers the phone. sigh
